摘 要:实证研究在诉讼法学研究中具有重要地位,但实证研究的质量却一直备受争议。通过对137篇诉讼法学实证研究论文的分析发现,以下两个问题的存在直接影响了研究成果的质量:一是现实中实证研究方法运用不规范、不科学,导致发现虚假现实,得出虚假结论;二是由于具体研究方法的还原性与研究对象的单一性,导致无法对复杂客体进行认识、预测与控制。因此,本文基于科学哲学的一般原理,举例论证了法学实证研究采用仿真建模技术的必然性与可行性,力求让法学实证研究成果更加精确科学,实现研究方法上的进步与飞跃。Empirical research plays an important role in legal research on procedural laws, but the quality of empirical research in procedural law has been controversial. Through the analysis of 137 empirical research articles in the procedural law, we find that the following two issues directly affect the quality of the research results: First, the empirical research methods are not standardized and scientific, leading to the discovery of false reality and conclusions;Second, because of the reductive nature of specific research methods and the unity of research objects, it is impossible to recognize, predict and control complex objects. Therefore, based on the general principles of scientific philosophy, this article demonstrates the inevitability and feasibility of using simulation modeling technology for empirical research in law, and strives to make the results of empirical research in law more accurate and scientific, achieving progress and improvement in research methodologies.
