论检察机关对司法职务犯罪案件的集中管辖

摘　　要：基于检察一体、法律监督、司法公正等理论基础及司法职务犯罪案件数量较少、检察机关侦查力量较弱、有相关犯罪的集中管辖范例可供参考等现实条件,建立对司法职务犯罪案件的集中管辖是必要的和可行的。对此,要克服案件线索不及时、诉讼效率降低以及突破现有侦查管辖规定等阻碍,选择铁路运输检察机关作为管辖机关,设立职务犯罪侦查部门办理案件、利用大数据和智慧检务系统开展侦查活动、规范职务犯罪侦查部门的办案程序,以及加强与监察机关的协调与配合,以提高检察机关的侦查能力,增强法律监督的刚性并加强对检察机关自侦权的监督,从而切实维护司法公正。Based on the theoretical basis of procuratorial integration,legal supervision,judicial impartiality,etc.,as well as the fact that the number of judicial duty crime cases is small,the procuratorial organ’s investigative power is weak,and there are examples of centralized jurisdiction for related crimes,a centralized collection of judicial duty crime cases is established.Jurisdiction is necessary and feasible.In this regard,it is necessary to overcome obstacles such as untimely clues,reduced litigation efficiency,and breakthroughs in existing investigation jurisdiction regulations,select the railway transportation procuratorial organ as the jurisdictional organ,set up a duty crime investigation department to handle cases,and use big data and smart inspections to carry out investigation activities systematically,standardize the case-handling procedures of duty-related crime investigation departments,and strengthen coordination and cooperation with supervisory organs,so as to improve the investigation capabilities of procuratorial organs,strengthen the rigidity of legal supervision,and strengthen the supervision of procuratorial organs’ self-investigation powers,so as to maintain judicial just.
