实际施工人制度的若干问题探究

摘　　要：我国城镇化进程中的客观社会环境催生了建设工程领域的实际施工人。实际施工人拖欠农民工工资情形的普遍存在严重影响了社会稳定。为了保障农民工的工资,维护农民工的劳动权益,我国以司法解释的形式创设了实际施工人制度,对我国建设工程领域的司法实践有重要影响。但该制度存在若干缺陷,如对实际施工人的认定标准不统一,没有限制实际施工人对合同相对性的突破,对实际施工人是否有权主张建设工程价款优先权存在争议,不能直接达到保障农民工工资的目的等。因此,需要完善实际施工人制度,统一实际施工人的认定标准,限制实际施工人对合同相对性的突破,赋予实际施工人主张建设工程价款优先权的权利,对该制度的适用应当契合保护农民工工资的目的。The objective social environment of urbanization of our country produces the actual constructors of the construction projects field.The ubiquity of condition which the salaries of migrant workers have been common by the actual constructors.The deficiency of law about the protection of labour rights of migrant workers have a strong impact on social stability.The system of actual constructor is established by the judicial interpretation of our country which in order to protect the salaries and labour rights of migrant workers.It also has important influence to judicial practice.But this system has some imperfection such as the identity standard of the the actual constructor is disunity.There is no limit for the actual constructors to break through the relativity of contract.And it exists disputed to the actual constructor which whether or not have right of claiming the priority right of compensation of construction project price.The current system cannot reach the purpose of protection of the salaries and labour rights of migrant workers.So it it necessary to perfect this system by unifying identity standard of the the actual constructor,limiting breaks of the relativity of contract,and giving the right of the actual constructors right of claiming the priority right of compensation of construction project price.The application of the system must conform to the purpose of protection of the salaries and labour rights of migrant workers.
