摘　　要：不起诉听证能够实现检察机关与公众的有效互动,一定程度上促进了检察机关不起诉决定的合理化。通过对《人民检察院审查案件听证工作规定》的文本解释,能够全面地解读案件类型、启动方式、听证员等不起诉听证的规范要素。目前,我国的不起诉听证仍存在一些问题。因此,应注重听证案件不起诉类型的多元化,促进不起诉听证的案件范围扩大化,细化听证员的选任与参会条件,以此助力不起诉听证的良性运转。Non prosecution hearing can realize the effective interaction between procuratorial organs and the public,besides,to a certain extent,promote the rationalization of the non prosecution decision.Through the text interpretation of the provisions of the people’s Procuratorate on the hearing of cases,we can more comprehensively interpret the normative elements of non prosecution hearing,such as the type of case,the way of starting,the hearing staff.At present,there are still some problems in the non prosecution hearing in China.Therefore,we should pay attention to the diversification of non prosecution types of hearing cases,promote the expansion of the scope of non prosecution hearing cases,further refine the selection and participation conditions of hearing staff,in order to promote the positive operation of non prosecution hearing.
