摘　　要：在全面推进乡村振兴战略背景下,农村闲置宅基地和闲置住宅的资源价值和财产价值凸显,对其盘活利用社会共识逐渐达成。向社会主体适度开放闲置宅基地和闲置住宅现象在我国地方实践中逐渐增多,引起了学术界关注。经过前期政策探索,闲置宅基地和闲置住宅盘活利用现已进入试点政策完善及总结阶段。“人”是乡村振兴的关键因素。试点探索实践表明,闲置宅基地和闲置住宅盘活利用必须突破乡村内部主体范围,引入社会主体,因此主体制度创新必不可少。基于公平与效率视角,创新闲置宅基地和闲置住宅盘活利用主体制度,需坚守公平价值优先的基本逻辑,恪守农民作为宅基地使用权基本主体的地位,树立底线思维。同时,遵循兼顾效率的基本逻辑,审慎推进宅基地利用主体范围的放活,促进宅基地土地资源有效利用,形成主体对资源的和谐利用关系,助力乡村振兴。Under the background of comprehensively promoting the strategy of rural revitalization, the resource value and property value of idle homesteads and idle houses in rural areas have become prominent, and a social consensus on their revitalization and utilization has gradually been reached. The phenomenon of moderately opening idle homesteads and houses to social subjects has gradually increased in local practice in my country, which has attracted the attention of academic circles. “People” is the key factor in rural revitalization. The pilot exploration practice shows that the revitalization and utilization of idle homesteads and idle houses must introduce social subjects, so the innovation of the main body system is essential. From the perspective of fairness and efficiency, to innovate the main system for the revitalization and utilization of idle homesteads and idle houses, it is necessary to adhere to the basic logic of giving priority to fair value, abide by the status of farmers as the basic subject of the right to use homesteads, and establish a bottom-line thinking. At the same time, following the basic logic of taking into account the efficiency, prudently promote the revitalization of the scope of the main body of homestead utilization, promote the effective use of homestead land resources, and help rural revitalization.
