摘　　要：中国的法制现代化进程属于外源型现代化,是由外在的压力所引发的,因此,就导致了中国固有的传统法律文化与移植而来的现代法律文化二元并存的局面。这两种法律文化从其内部关系来看,既存在着彼此统一协调的一面,也存在着互相排斥冲突的一面。而法治中国的顺利实现,就必须采取有效措施来促进两种法律文化的和谐,同时消解彼此间的矛盾冲突。主要的步骤就是,要在推进法治建设的过程中,进一步促进传统法律意识的现代化转化,同时促成传统法律制度某种形式的再生。The process of China’s modernization of law belongs to the exogenous modernization, which is caused by external pressure. As a result, it leads to the binary mixture of China’s inherent traditional legal culture and the transplanted modern legal culture. From the perspective of their internal relations, these two legal cultures not only have the aspect of unification and coordination, but also have the aspect of mutual exclusion and conflict.For the successful implementation of the rule of law in China, effective measures must be taken to promote the harmonization of the two legal cultures and to resolve the contradictions and conflicts between them. The main method is to further promote the transformation from the traditional legal consciousness to the modernization one as well as facilitate some forms of regeneration of the traditional legal system in the process of promoting the construction of the rule of law.
