涉外法治人才培养的英国实践及其借鉴

摘　　要：在经济全球化日益复杂的进程中,我国面临日益严峻的国际法律风险。打造一支优秀的涉外法治人才队伍是成功应对该风险的人才保障。考察英国涉外法治人才培养模式,发现其特点包括国际律师定位的培养目标、律师协会有效监管的培养过程、法律素养和专业技能并重的培养内容。我国可立足国情借鉴英国实践,遵循试点改革和严格监管的路径,从法学本科教育、法学研究生教育和律师实习三个方面综合改革涉外法治人才培养模式。In the increasingly complex process of economic globalization,China is facing increasingly harsh international legal risks.To build an outstanding team of the rule-of-law talent who handles foreign-related matters is the personnel guarantee for successfully coping with this risk.This article examines the talent cultivation model of the rule-of-law talent who handles foreign-related matters in the United Kingdom and it finds that the various characteristics include the cultivation goals of international lawyers,the cultivation process of effective supervision of the bar association and the cultivation content of legal literacy and professional skills.Based on Chinese specific conditions,the successful experience of the United Kingdom can be learnt and borrowed by following the path of pilot reform and strict supervision,and comprehensively reform the cultivation model of the rule-of-law talent who handles foreign-related matters in the United Kingdom from the three aspects:undergraduate legal education,postgraduate legal education and lawyer internship.
