网络话语权的异化现象及其法律规制

摘　　要：随着互联网技术的发展,话语权逐步突破传统媒体的限制,在网络平台实现了前所未有的话语空间。网络原发的匿名性、开放性、平等性却成为网络环境安全的漏洞,产生了诸多不可预知的、与网络话语权正向性特质相背离的异化现象。网络话语主体的异化、话语载体的异化、话语功能的异化以及话语环境的异化等现象成为网络话语权与各类私权利、公权力冲突的根源。鉴于当前网络话语权的异化乱象,建议遵循保护和限制相结合的原则对网络话语权做出明确的法律规制。With the development of Internet technology,the discourse right gradually breaks through the limitation of traditional media and achieves unprecedented discourse space in the network platform.However,the anonymity and openness of the network have become the loopholes in the security of the network environment,resulting in many unforeseen alienation phenomena which deviate from the positive influence of the network discourse right.The alienation of the subject,the carrier,the function and the environment of the Internet discourse has become the root of the conflict between the Internet discourse right and various private rights and public power.
