横琴粤澳深度合作区借鉴澳门民众诉讼制度的可行性分析

摘　　要：基于特殊历史原因,葡萄牙民众诉讼制度的简易变体在中国澳门特别行政区的《民事诉讼法典》和《行政诉讼法典》中皆以法条形式被固定,民众诉讼制度于中国相关法律文本中实际有迹可循。随着有关横琴粤澳深度合作区(下称“横琴合作区”)建设的政策文件及司法文件的相继出台,横琴合作区依靠其特殊的管理机制和充足的改革空间,在含有涉澳因素的公益诉讼领域吸收借鉴澳门民众诉讼制度因同时获得政策和法律双重基础而具备可行性。Due to the historical reason,the simplified variant of the Portuguese popular action was fixed in the Civil Procedure Code and Administrative Procedure Code of Macao,so the popular action system can be followed in the relevant legal texts in China.With the issuance of policy documents and judicial documents on the construction of demonstration zone of in-depth cooperation among Guangdong—Macao in Hengqin (hereinafter referred to as "Hengqin Cooperation Zone"),based on its unique management mechanism and ample room for reform,Hengqin Cooperation Zone is feasible to drawing lessons from Macao’s popular action system in the field of public interest litigation involving Macao factors because it has obtained both policy and legal basis.
