黑恶势力犯罪案件涉案财产处置的法律监督问题探讨

摘　　要：近年来,黑恶势力犯罪案件涉案财产处置法律监督的探索不断推进,体现在有关方面积极参与立法、勇于实践、主动作为、全面落实“少捕慎诉慎押”刑事司法政策等方面,取得了明显成效。但此项工作还存在相关法律规定不完善、部分法律监督机关履责不够积极规范和有的被监督者配合不力等问题。为解决这些问题,人民检察院应在坚持宪法定位,树立法律监督新理念的前提下,对黑恶势力犯罪案件涉案财产处置实行全程监督,在审前程序中加强涉案财产强制措施的司法审查,推进追诉定罪与涉案财产处置并重的办案方式,在审判程序中构建相对独立的涉案财产调查程序,尝试适度减轻控方的证明责任,在审后程序中实行审执分离,加强对涉案财产执行的法律监督,规范、合法和有效解决民法典实施后的刑民交叉问题。The exploration of legal supervision over the disposal of property involved in gang-related cases has been continuously promoted in recent years,which is reflected in the active participation of relevant parties in legislation,the courage to practice,the initiative to fully implement the criminal justice policy of less arrest,cautious prosecution and de⁃tention,and has achieved obvious results.However,there are also some problems in the supervision,such as imperfect le⁃gal provisions,insufficient active regulation by some legal supervision organs,and insufficient cooperation by some super⁃vised persons.In order to solve theses problems,the People’s Procuratorate should,on the premise of adhering to the posi⁃tioning of the Constitution and establishing the new concept of legal supervision,carry out whole-process supervision over the disposal of the property involved in the crime cases of the evil forces.The judicial review on compulsory measures of property involved in pre-trial procedures should be strengthened.The case handling method that attaches equal importance to prosecution and conviction as well as disposal of property involved should be promoted.Relatively independent investiga⁃tion procedures of property involved in trial procedures should be constructed.Proof burden of the prosecution should be moderately reduced.The separation of trial and execution should be implemented in the post-trial procedure.The legal su⁃pervision over execution of the property involved should be strengthened.Intersection of civil law and criminal law after the implementation of the civil code should be solved normatively,legally and effectively.
