摘  要:在共享经济快速发展过程中,网约平台用工模式呈现出不同于传统用工模式的新特点,网约工为代表的新业态劳动者合法权益难以有效保障的问题日益凸显,对我国现行劳动法律治理体系提出了新的时代挑战。基于网约工劳动权益保障的制度困境以及网约工类型呈现形态多样化、网约工与平台之间的法律关系复杂化、平台对网约工的控制与剥削更加隐蔽化的用工特点,“非标准劳动关系”理论不仅丰富和完善了传统劳动关系理论,而且为我国网约工权益保障提供了一种新的用人责任划分的法理视角。“按量担责法”基于“非标准劳动关系实质是标准劳动关系的微分化”这一内在特征,不仅可以有效回答网约平台或第三方合作商应当怎样担责这一问题,而且可以为构建和谐、有序的平台劳动用工法律关系,健全和完善我国现行劳动法律制度体系提供科学选择。In the process of rapid development of the sharing economy,the employment mode of the online employment platform presents new characteristics different from traditional employment mode.The problem that the legitimate rights and interests of workers in the new industry represented by online employment are difficult to effectively protect is becoming increasingly prominent,posing new challenges to the current labor law governance system in China.Based on the institutional dilemma of the protection of labor rights and interests of online contract workers and the employment characteristics of diversified forms of online contract workers,complicated legal relationship between online contract workers and platforms,and more concealed control and exploitation of online contract workers by platforms,the theory of"non-standard labor relations"not only enriches and improves the traditional labor relations theory,but also provides a new legal perspective on the division of employment responsibilities for the protection of online contract workers′rights and interests in China.Based on the inherent characteristics of"non-standard labor relations are essentially the micro differentiation of standard labor relations",the"volume based responsibility method"can not only effectively answer the question of how the online contract platform or third-party partners should bear the responsibility,but also provide a scientific choice for building a harmonious and orderly platform labor employment legal relationship,and improving and perfecting China′s current labor legal system.
