摘  要:“权利说”“权力说”以及“复合说”的法律性质之争中,“权力说”更契合中小学教育惩戒行为的法律关系分析、行为设定目标以及权源追溯等构成要素。学校教育惩戒行为是学校行使国家教育权的具体方式,带有明显公权力属性;教师教育惩戒行为是教师基于其专业身份及与学校之间的“教育法上的职务关系”所行使的一项公法意义上的职务行为,是国家教育权的延伸。教育惩戒行为的育人属性使其不同于行政处罚权和行政处分权,“教育措施说”可以消除“教育管理权说”带来的“重管理轻教育”、泛化使用等弊端,并将教育惩戒行为准确定性为学校及教师基于培养学生规则意识的目的,对规范学生日常行为实施的教育行政措施。In dispute over the legal nature of “right theory”, “power theory” and “compound theory”, the “power theory” is more in line with the constituent elements of the legal relationship analysis, behavior setting goal and power source tracing of educational disciplinary behavior in primary and secondary schools. School education disciplinary behavior is a specific way for schools to exercise the state power of education, which has an obvious attribute of public power;teachers. educational disciplinary behavior is an occupational behavior in the sense of public law exercised by teachers based on their professional identity and the “job relationship in education law” with schools. It is an extension of the state power of education. The educational attribute of educational disciplinary behavior makes it different from the punishment authority of administrative penalty and the power of administrative sanction. The theory of “educational measures” can eliminate the disadvantages of “emphasizing management over education” and generalized use brought by the theory of “educational management power”, and accurately characterizes the educational disciplinary behavior as the educational administrative measures implemented by schools and teachers to standardize students. daily behavior for the purpose of cultivating students.awareness of rules.
