摘　　要：行政公益诉讼调查取证权是检察机关开展行政公益诉讼工作的一把利刃,能够有效地保障检察机关行使法律监督职权。在行政公益诉讼中,调查取证权是检察机关维护国家和社会公共利益的一项重要权力,其本质上也是检察机关法律监督权的衍生权力。从当前实践来看,行政公益诉讼调查取证权的发展虽然取得了一定成就,但依旧呈现弱小态势,且所涉及的相关证据制度也不尽完善。为此,有必要赋予检察机关司法强制权、优化调查取证的证据制度设计、细化案件调查取证程序,以保障并规范行政公益诉讼调查取证权运行。The power to investigate and collect evidence of administrative public interest litigation is a sharp edge for the procuratorial organs to carry out the administrative public interest litigation work,which can effectively guarantee the procuratorial organs in the exercise of legal supervision authority.In administrative public interest litigation,the power of investigation and evidence collection is an important power for the procuratorial organs to safeguard the public interests of the state and society,and in essence it is also the derivative power of the procuratorial organs legal supervision of supervision.From the current practice,although the development has made some achievements in the power of investigation and evidence collection of administrative public interest litigation,it still presents a weak trend,and the relevant evidence system involved is not perfect.Therefore,it is necessary to give the procuratorial organs the judicial coercive power,optimize the design of the evidence system of investigation and evidence collection,and refine the procedures of case investigation and evidence collection,so as to guarantee and standardize the operation of the investigation and evidence collection power of administrative public interest litigation.
