摘 要:实践中,囿于各种主观和客观因素,农村土地承包经营权证上载明的内容与土地实际状态不相符的情况并不少见。土地承包经营权证记载有误存在承包人名字错误、遗漏承包人、土地信息错误、权属“名实不符”等多种情形。这些案件进入法院后,收案阶段,对诉讼材料的形式审查容易导致案件诉讼程序混乱;调查取证阶段,调查目的之实现依赖于发证的不动产登记机构;审理裁判阶段,民事法律关系与行政法律关系交织、民事审判与行政审判交叉。针对这些问题,法院应从收案环节的程序把控、审理阶段的实质审查、结案环节的“调、裁、判”适用对民事诉讼各流程进行优化,从而促进规范、公正地处理农村土地承包纠纷案件。In practice,due to various subjective and objective factors,it is not uncommon for the content stated in the rural land contractual management certifi cate to be inconsistent with the actual state of the land.There are errors in the record of the land contractual management certifi cate,such as the wrong name of the contractor,the omission of the contractor,the wrong land information,and the“discrepancy between the name and the reality”of the ownership.After these cases enter the court,the formal review of litigation materials is likely to lead to confusion in the proceedings of the cases;in the stage of investigation and evidence collection,the realization of the purpose of investigation depends on the real estate registration agency issuing the certifi cate;in the trial and adjudication stage,civil legal relationship and administrative legal relationship are intertwined,and civil trial and administrative trial are intertwined.To solve these problems,the court should optimize the processes of civil litigation from the procedural control in the process of receiving cases,the substantive review in the trial stage,and the application of“mediation,adjudication,and decision-making”in the process of closing cases,so as to promote the standardized and fair handling of rural land contract disputes.
