高校监察机构监察对象及其管辖疑难问题分析

摘　　要：党的二十大报告强调,加强师德师风建设,培养高素质教师队伍。将公办高校教师纳入监察对象的范围,加强高校教师师德师风等的监督,是贯彻党的二十大精神的重要体现。对于因外调从事管理工作的高校教师,需要结合其从事的管理工作事项、地域与干部本身的管理权限确定监察管辖权。对于高校管理权限范围内监察对象的违法行为,应当结合是否具有领导职务、违法行为性质及情节等“三要素”,合理构建高校监察机构与高校调查、处置管辖分工标准,确保政务处分与处分协调有序。The 20th CPC National Congress Report stresses the teachers’ethics and the cultivation of high-quality teachers.It is a highlight of the Communist Party of China’s spirit that prioritizes the teachers’ethics and conduct,ideology and other things alike when it comes to state-run colleges and universities’teachers as subjects of supervision.Those teachers transferred outside for management affairs should be given management right according to their work,regions and duties of management;for those violating law,considerations should be rendered concerning their presence vs.absence of leadership,nature of illegal acts,and degree of law breach.In this way rational supervising agencies can be constructed in universities and colleges,the proper management division standards can be set up,and the administrative penalty and the penalty coordination can be made orderly.
