摘 要:自动驾驶汽车的核心目标是提高道路交通的安全性,但人工智能和网络技术的使用却增加了自动驾驶技术的网络风险。车辆的电子元件、软件以及网络连接若遭遇黑客攻击或发生意外事故,则将导致损害赔偿。对于事故责任的划分应依照严格责任、过错责任等法律原则进行责任认定和分配,并从我国自动驾驶汽车的内生网络安全规范建设、保险制度的创新以及“黑匣子”技术的使用等方面做出法律应对措施。A primary goal of autonomous vehicles is to increase the road traffic safety.However,the use of artificial intelligence and network technology in the autonomous vehicles has added cyber security risk to the self-driving technology.If electronic control units,software,and network connection of the autonomous vehicles are attacked by hackers or suffer from cyber security failures,damages will occur in consequence.The division of accident responsibility shall be determined and distributed in accordance with legal doctrines such as strict liability and negligence liability.Legal measures for the cyber security breaches of the autonomous vehicles include the cyber security policy and specification construction for the autonomous vehicles of China,the innovative insurance policies for the autonomous vehicles,and the use of“black box”in the autonomous vehicles.
