摘  要:近年来,现代化要素不断重构着社会秩序、社会结构与社会文明程度,诱发了裂变式的社会变革,将人类社会的治理理念、学习理念、发展理念提升至前所未有的高度,生存权和受益权的实现状况已然不是人们的关注对象,转而强调教育的自主、自决、自立,倾向由内源性动力和自发性行为而衍生的产品,由此教育权的另一面——教育选择权成为新的权利主张。教育强制与教育自由在一定程度上建构了教育选择权的内涵,揭示了其运行过程中的表层现象及深层原因。解决这一问题的出路在于“多向式”赋予学生主体教育选择权的权力、“市场化”拓宽学生主体教育选择权的范畴、“一体化”保障学生主体教育选择权的行使,从而深化教育管理改革,逐步有序地实现学生教育选择权的回归。In recent years,the elements of modernization have continuously reshaped the social order,social structure and social civilization,inducing fission-like social changes and enhancing to an unprecedented height the concept of governance,learning and development of human society.People’s attention has been shifted from the realization of the right to survival and benefit to the autonomy,self-determination and self-reliance of education,preferring to a product derived from endogenous motivation and spontaneous behavior.Therefore,the right to educational choice-the other side of the right to education-has become a new claim.Educational compulsion and educational freedom constitute the connotation of educational choice to a certain extent,and reveal the surface phenomena and deep reasons in its operation.The solution to this problem lies in the following aspects:granting students the right to choose education with more than one direction,broadening students’educational selections with the help of market and ensuring the exercise of students’educational selections with an integrated system.It may help deepen the reform of education management and gradually and orderly realize the return of students’right of educational selections.
