摘　　要：基于111份裁判文书,分析重复起诉条款与部分请求的关系,明确法院只有在原告满足条件时才能容许提起后诉,法官应积极释明,充实对前诉的审理,宽待诉讼变更请求,以回应现实诉求,维护司法统一,对部分请求作出体系化规制。Based on 111 judicial documents,this thesis analyzes the relationship between the repeated prosecution clause and some claims,and makes it clear that the court can only allow the plaintiff to file a subsequent lawsuit when the plaintiff meets the conditions.The judge should actively explain,enrich the trial of the previous lawsuit,and give leniency to the request for litigation change in order to respond to realistic demands,maintain judicial unity,and systematically regulate some claims.
