摘　　要：作为一种新型送达方式,电子送达突破了传统送达方式的地域局限,在保障“通知”功能的同时,提升了送达效率。虽然当前全国各地法院都在探索适用电子送达,但其仍存在排除适用规定空白、送达方式不一、适用顺位不明等困境。对此,应以电子送达的法律适用要件为基础,增设电子送达的排除适用规定,对于受送达人不同意、不具备网络操作能力、电子送达地址不明确的不应适用电子送达。以诉讼类型为区分试点,明确电子送达的适用方式,对于在线诉讼应统一适用新型电子送达平台,而线下诉讼则应以受送达人的同意模式予以类型化区分。以法院类型为基准,厘清电子送达的适用顺位。在互联网法院中应优先适用电子送达,在普通法院中除受送达人明示同意适用电子送达外,一般应遵循“传统送达方式为主、电子送达为辅”的适用顺位。As a new way of delivery, electronic delivery breaks through the geographical limitation of traditional delivery methods and improves the efficiency of delivery while ensuring the function of "notice".Although courts all over the country are exploring the application of electronic delivery in full swing, there are still some dilemmas, such as blank exclusion of applicable provisions, different ways of delivery, and unclear order of application.In this regard, based on the legal requirements for electronic delivery, the exclusion of electronic delivery should be added up, and electronic delivery should not be applied to those who do not agree with the addressee, do not have network operation ability, and have unclear electronic service address.Taking the type of litigation as a pilot, the applicable method of electronic delivery should be clarified.For online litigation, the new electronic delivery platform should be uniformly applied, while offline litigation should be classified by the consent mode of the addressee.Based on the court type, clarify the applicable order of electronic delivery.In internet courts, electronic delivery should be given priority, and in ordinary courts, unless the addressee expressly agrees to apply electronic service, the application order of "traditional service as the main, electronic service as the supplement" should be followed.
