摘 要:我国《仲裁法》即将迎来其颁布以来的首次大幅修订,司法部发布的《仲裁法(修订)(征求意见稿)》不仅对我国现有仲裁法制的诸多不足作出了实质性修改,同时也为兼容投资仲裁制度作出了有益尝试。随着我国“一带一路”倡议的深入推进,我国国家和私人参与投资仲裁的数量持续增长,如何为其提供完善、适配的仲裁法律框架是我国的现实需求。为此,《征求意见稿》及配套规范宜从确保投资争议的可仲裁性、预留内部上诉制度空间,以及便利投资仲裁裁决的承认与执行等方面着力,切实保障投资仲裁未来在我国的顺利开展与良好运行。China’s Arbitration Law is about to be substantially revised for the first time since its enactment. The(Revised) Arbitration Law(Draft for Comments) released by the Ministry of Justice not only makes significant modifications to the deficiencies of the current Arbitration Law, but also makes a beneficial attempt to accommodate investment arbitration system. With the deepening of China’s Belt and Road Initiative and the increase of investment arbitration cases involving Chinese government and investors, how to provide an appropriate legal framework has become the realistic demand of China. Therefore, the Consultation Draft and relevant regulations should focus on ensuring the arbitrability of investment disputes, contemplating internal appeal mechanism, and facilitating the recognition and enforcement of investment arbitral awards, so as to guarantee the smooth development and good operation of investment arbitration in China in the future.
