摘  要:为了构建城乡统一建设用地市场框架,本文引入土地发展权,基于复杂适应系统理论,我们发现城乡统一建设用地市场的运行过程是一个具有明显目标导向的,以农民、集体经济组织、地方政府和企业法人等市场参与者为适应性主体的,非线性、多样性的复杂动态过程。城乡统一建设用地市场这一复杂适应系统所处的外界环境主要为国土空间规划与用途管制以及政策环境和制度法律保障,内置规则为土地发展权的配置与转移以及各市场主体间的博弈分析。根据内置规则,城乡统一建设用地市场主体的适应性行为将产生各种效果。应积极引入土地发展权政策工具,完善土地产权体系,保障各主体的合法权益,使城乡统一建设用地市场高效公平地运行。In order to build a framework for a unified market for urban-rural land of construction,this article introduces the concept of the land development right.Based on the system for the rights of land property and the theory of complex adaptive system,this article finds that the operational process of building a unified market for urban-rural land of construction has a clear goal.Non-linear,diverse,and dynamic,this process involves farmers,collective economic organizations,local governments,corporate juridical persons,and other market participants.The external envi-ronment of this complex adaptive system legally safeguards the spatial planning,use,and control of land as well as the policy,environment,and institution in this regard.The built-in rules include the allocation and transfer of the rights for land development and the game analysis of different players in the market.According to the built-in rules,the adaptive behavior of the subjects in the unified market for urban-rural land of construction has various effects.We should introduce the policy tool for the rights of land development in order to improve the system for the rights of land property,safeguard the legal rights and interests of all the subjects,and make the unified market for urban-rural landof construction efficiently,fairlyoperate.
