摘 要:“少捕慎诉慎押”司法理念对少年司法工作提出更高要求,检察机关应当系统性地控制批准逮捕率、提升相对不诉率、降低审前羁押率,切实强化对涉罪未成年人的司法人权保障。一般只对造成重伤以上人身损害后果、强奸、绑架,或者可能判处十年有期徒刑以上刑罚的案件批准逮捕。对于法定刑为三年有期徒刑以下刑罚的案件,如果在“未成年人”“坦白”“认罪认罚”之外,还存在其他法定、酌定从轻减轻情节,一般应当作相对不起诉处理。对于法定刑为三年有期徒刑以上刑罚的案件,如果具有“自首”等法定免除处罚事由,也可视情形作相对不起诉处理。应当从有利于涉罪未成年人的角度适用“可能判处徒刑以上刑罚”,坚持动态化评估社会危险性,出现新的事实、证据或者量刑情节,导致案件可能判处徒刑以下刑罚的,及时变更为非羁押性强制措施。The judicial concept of "fewer arrests and more cautious prosecutions and more cautious detentions" places higher demands on juvenile justice,and the procuratorial authorities should systematically control the rate of approved arrests,increase the rate of relative non-prosecution,and reduce the rate of pretrial detention,so as to effectively strengthen judicial human rights protection for minors involved in crimes. For cases where the statutory penalty is less than three years imprisonment,if,in addition to "minor", "confession" and "guilty plea",there are other statutory and discretionary mitigating circumstances,they generally should be relatively non-prosecuted. It should be applied from the perspective of the benefit of the minor involved in the crime "may be sentenced to imprisonment or more".
