摘　　要：本文对美国司法部“中国行动计划”的制定实施情况进行研究,分析该计划实施近4年时间内发布的具体案件情况,从政策实践的角度揭示美国政府遏制中国科技创新具体行动计划所涉及的核心议题,全面、准确地研究美国政府在限制中美科技人才交流过程中采取的法律手段措施,从而为我国科技人才保护制度的建设提供有指向性、针对性的建议。This paper studies the formulation and implementation of the Department of Justice’s China Initiative,analyzes the specific cases issued within the four years of implementation of the plan,reveals the core issues involved in the specific action plan of the US government to curb China’s scientific and technological innovation,comprehensively and accurately studies the measures taken by the US government in the process of legally restricting the exchange of scientific and technological talents between China and the United States,so as to provide directional and targeted suggestions for the construction of China’s scientific and technological talent protection system.
