论开发区管委会行政诉讼被告资格的判定标准

摘　　要：开发区管委会是否具有行政诉讼的被告资格关系到行政争议能否通过诉讼方式加以解决.即便我国司法解释中已经采用双重判定标准对开发区管委会的被告资格进行判定,但受历史因素、实践情况以及相关理论研究存在争议的影响,双重判定标准未能与司法实践中的情形实现完全契合,加大了各地法院判定涉及开发区管委会的行政争议适格被告的难度.通过引入最密切联系原则,规范相关概念的适用情形,明晰开发区管委会的法律主体性质,进一步细化授权范围的方式构建开发区管委会诉讼被告资格的判定标准,以便法院对案涉争议进行后续的实质审理,促进行政争议的实质性化解.Whether the management committee of the development zone has the qualification of a defendant in administrative litigation is related to whether administrative disputes can be resolved through litigation.Even though China's judicial interpretations have adopted the double judgment criterion to determine the qualifications of the defendants in the management committees of the development zones,due to the controversy over historical factors,practical situations and relevant theoretical research,the double judgment criteria have not been fully consistent with the situation in judicial practice,which has increased the difficulty for courts in various places to determine that the administrative disputes involving the management committees of the development zones are eligible for the defendants.By introducing the principle of closest connection,standardizing the application of relevant concepts,clarifying the nature of the legal subject of the management committee of the development zone,and further refining the scope of authorization,the criteria for determining the qualifications of the defendant in the litigation of the management committee of the development zone are constructed,so that courts can conduct a subsequent substantive trial of the dispute involved in the case and promote the substantive resolution of the administrative dispute.
