摘 要:行政机关有权依职权对自己作出的违法瑕疵行政行为进行撤销,该类撤销权的行使即为行政职权撤销。于行政机关而言,此种撤销权的存在不仅是一种职权,亦是一种职责。然而将已生效的行政行为撤销,势必会使得法的安定性、利益相关人的信赖利益以及公共利益受到不利影响,所以有必要对行政撤销权作出行使期间规定与程序性规定两方面的限制。针对四类具体类型的行政行为,即授益性行政行为、负担性行政行为、涉第三人利益的复效行政行为以及瑕疵自然补正的行政行为,行政机关应当对它们可否撤销以及如何撤销有不同的处理规则。The administrative organ has the right to revoke its illegal and defective administrative act according to its authority, and the exercise of this kind of cancellation right is the revocation of administrative power. For administrative agencies, the revocation power is not only a kind of power but also a kind of duty. However, the revocation of the effective administrative act will adversely affect the stability of law, the trust interests of stakeholders and the public interest, so it is necessary to restrict the administrative revocation right from the two aspects of the period and procedural provisions. Aiming at four specific types of administrative acts, namely,beneficial administrative acts, burden administrative acts, reeffect administrative acts involving the interests of the third party, and administrative acts naturally correcting defects, administrative organs should have different treatment rules on whether or not they can be revoked and how to revoke them.
