监检衔接中检察机关职务犯罪侦查权困境与完善  

Dilemma and Perfection of Procuratorate's Investigation Power on Duty-Related Crimes During the Connection Between Supervisory Organs and Procuratorial Organs

摘　　要：监察体制改革后,绝大部分的职务犯罪归属监察机关依法立案调查,而现行《刑事诉讼法》为检察机关保留了限于“对诉讼活动实施法律监督过程中”的部分职务犯罪侦查权,无论从宪法法律赋予检察机关的职能定位还是检察机关作为主体直接参与诉讼活动的履职优势条件来说,保留这部分职务犯罪侦查权是正当的,也是必要的。但保留的一部分职务犯罪侦查权行使过程中却面临着与监察机关管辖竞合、案件分配管辖机制不明,犯罪嫌疑人(被调查人)权利保障陷于风险和机构人员转隶后侦查力量不足等困境,对此应深化监检沟通合作、明确案件分配管辖机制,建立监察案件分流机制、提升涉罪被调查人权利保障水平和强化侦查力量、加强队伍建设来避免制度虚置,切实促进检察机关职务犯罪侦查权的行使达到应然水平和制度设计的预期目标。After the supervision system reform,even though the majority of duty-related crimes are registered and investigated legally by the supervisory organs,part of such investigation power limited to the process of legal supervision over litigation activities has been reserved for the procuratorial organs according to the current Criminal Procedure Law.It is justified and necessary to reserve the power no matter from the perspective of supervisory organs’functional role entrusted by Constitution and other laws or from the perspective of supervisory organs’advantages while participating in litigation activities directly as main body.However,during the practice,such power faces such dilemma as jurisdictional competition and unclear case distribution with supervisory organs,the right protection for suspects in risk and the investigator shortage after personnel transfer.Therefore,communication and cooperation between supervisory organs and procuratorial organs should be deepened;case distribution and administration should be clear;a diversion mechanism should be built;right protection ability for suspects should be improved;investigation force of personnel and team should be strengthened,to avoid that the system is merely nominal,so as to effectively promote the investigation power exercise performance on duty-related crimes by procuratorial organs and achieve the expected objectives.
