我国家事程序专门立法的远期愿景  

On the Long-term Vision of Chinese Family Procedure Legislation

摘　　要：我国家事审判改革的地方性探索始于20世纪末,2016年起的“家事审判方式和工作机制改革试点工作”将其推向全国,试点工作明确提出“家事诉讼特别程序”的立法命题作为改革的远景式目标。新近《民法典》的颁行标志着我国家事法正式采用“实体与程序分立并行”的体系构造,未来更应加速推动“家事诉讼特别程序”的专门立法进程。为此,不仅要顺应于世界家事程序发展的现代化趋势,狭义定位“民事程序”概念以剥离“家事程序”范畴而采取“家事程序单行立法模式”;更须立足于我国民事程序立法的客观性现实,折衷“二元分化”与“一元统合”程序法理,以选择“统一文本下之二元分化体例”而令“家事诉讼程序”与“家事非讼程序”协力并行。Chinese exploration on family trial reform at local levels has begun since the end of last century and began to expand nationwide in 2016 by the Pilot Work on Reform of Family Trial Methods and Working Mechanisms. The Pilot Work has formally put forward the Legislation on Special Procedures for Family Proceedings as the long-range objective of Chinese family trial reform. As the recent enactment of Chinese Civil Code marks China’s official adoption of the family law system architecture which separates procedures from entities and makes them parallel, so we should more accelerate the specialized legislation process on Special Procedures for Family Proceedings. For this purpose, we must conform to the modern development trend of family procedures in the world and embrace the Separate Family Procedure Legislation Model which narrowly defines the concept of Civil Procedure to separate the category of Family Procedure. Besides, we are to stand on the objective reality of Chinese civil procedure legislation and choose the Separate Legislation Style of Duality Differentiation in Unified Text which integrates Duality Differentiation Theory and Unitary Integration Theory to make the Family Litigation Procedures and Family Non-litigation Procedures work together in parallel.
