刑事案件远程讯问的运行风险与优化路径——以疫情期间讯问工作为切入点

摘　　要：在实践中,远程讯问展现出提升司法工作效率、保护生命健康、加强监督、避免刑讯逼供的正向价值,但也存在侵犯犯罪嫌疑人诉讼权利、削弱讯问质量、损害案件信息保密性的问题。为解决远程讯问适用中存在的问题,应明确规定远程讯问案件适用范围、诉讼程序,引入3D“面对面”音视频技术,完善远程讯问软硬件,搭建司法专用内网,从根本上纾解远程讯问在刑事司法和远程信息技术衔接中出现的现实困境。In practice,the remote interrogation has shown positive values of increasing judicial efficiency,protecting life and health,strengthening supervision,and avoiding forced confessions under torture.On the other hand,it may violate litigation rights of the suspects,undermine the result of interrogation,and breach the confidentiality of case investigation.In order to solve the above problems in remote interrogations,it should stipulate the scope of application to remote interrogation cases and litigation procedures,introduce 3D“face-to-face”audio and video technology,upgrade the software and equipment,and build a specific judicial intranet to thoroughly solve the predicaments of remote interrogation cause by the link up with remote IT.
