摘 要:被诉行政行为不需要撤销是适用行政诉讼确认违法判决的法定情形之一。现有立法将“不需要撤销的行政行为”分为“不具有可撤销内容的行政行为”和“经被告改变后的被诉行为”两类。这一分类存在指向不明、逻辑不清的问题,导致司法实践中无法准确适用确认违法判决,影响了对行政相对人的权利保护。“不需要撤销的行政行为”本质上是“效力无法被撤销的行政行为”,包括“行政事实行为”“不复存在的行政行为”“内容得到实现且不能恢复原状的行政行为”三类,据此适用确认违法判决能够更加准确明晰。One of the statutory circumstances for the application of affirming illegal judgment is that the sued administrative act does not need to be revoked.The existing legislation classifies“administrative acts that do not need to be revoked”into two categories:“administrative acts that do not have revocable content”and“acts being sued after being changed by the defendant”.This classification has the problem of unclear direction and incomplete logic,which leads to the failure to accurately apply and confirm the illegal judgments in judicial practice,which affects the protection of the rights of a private party in administration.The administrative act that does not need to be revoked is essentially an administrative act whose effect cannot be revoked.Logically,the effect cannot be revoked and may consist of three types:non-effective administrative factual acts,administrative acts that no longer exist,and administrative acts whose contents have been realized and cannot be restored to their original condition.
