建设工程设计合同中的资质纠纷探析

摘　　要：虽然设计人没有相应资质通常会导致建设工程设计合同无效,但某些类型的建设工程设计合同是否需要相应资质,实践中因设计对象或标的物、具体设计工作内容的不同,存在不同认识。结合我国法律法规中关于设计资质的管理规定和建设工程设计的专业特点,针对几种典型类型的设计合同,具体分析设计资质对合同效力的影响,并据此得出相应的结论。Although the designer’s lack of corresponding qualification usually leads to the invalidity of the construction project design contract,there are different understandings on whether certain types of construction project design contracts need corresponding qualification due to different design objects or objects and specific design work contents in practice. Based on the management regulations on design qualification in China’s laws and regulations and the professional characteristics of construction engineering design,this paper analyzes the impact of design qualification on the effectiveness of contracts for several typical types of design contracts,and draws corresponding conclusions accordingly.
