论党内问责的归责原则——以规范分析为进路

摘　　要：从规范层面来看,归责原则的确立对于党内问责制度的构建具有重要意义,其关系到问责对象的范围、问责情形的设置和问责方式的适用等问题。在确立党内问责的归责原则时,必须遵循如下标准:一是要区分行为过程和结果并能够形成对二者的双重权衡;二是要实现约束和激励的并重兼容;三是要体现对民意的回应。从既有归责原则的规范构造来看,虽然初步确立了行为责任原则、结果责任原则和过错责任原则,但是存在归责原则的性质及其内容含混不清、适用对象区分不明和适用比例不够合理等诸多不足之处。对此,可以从三个方面给出完善建议:首先,采用一般条款和类型化设定相结合的方式进行归责原则的构造;其次,建立适合归责原则具体化适用的责任清单制度;最后,明确和细化免责事由的内容。The establishment of principle of liability is essential for the intra-party accountability system, which determine questions of accountability objects, accountability situations and accountability approaches.The criteria set out for the principle of liability of the intra-party accountability are as follows: firstly, the processes of acts and the consequences of acts should be kept separate when they are measured equally;secondly, there must be some rules of balancing the functions of constraint and encouragement rooted in the intra-party accountability system;thirdly, the principle of liability can reflect public opinion.The principle of liability for acts, the principle of consequential liability and the fault liability principle are established in accordance with those mentioned criteria.However, the normative structure of principle of liability raises a number of problems involving the ambious definition,the confusable applicable objects and the improper applicable proportion.To improving the structure of principle of liability, the solutions can be provided in three aspects.First of all, the normative structure of principle of liability should be constituted by the general clause and the classification of principle.Secondly, it is necessary to set up the responsiblity list for the application of principle of liability.In the end, the grounds for exemption are requsted in order to adjust the range of application of liability principle.
