摘  要:在我国积极参与全球治理体系改革和建设的新时代,国家对涉外法治人才培养提出新任务和新要求。传统培养机制存在的与国家战略需求不匹配、涉外法治人才和平台地区分布不均衡、配套教育资源和服务供应不足、培养成效评价机制欠缺等影响课程建设的问题亟待改革。未来应当发展法教义学范式,构建一套以国际法为本体的内生性规范体系。包括倡导以“规范获取”为逻辑起点,以法律适用为核心内容,以权利救济为根本依归的教学体系。而且应注重“新文科”理念下的学科交叉,以及法学和外语教学的深度融合,进而建构“专业+外语”的“三位一体”人才培养机制。建议司法部及时推出与现有法律职业资格考试并行、非强制性的涉外法律职业资格考试。最后,应深度引入涉外实务部门的人力资源,共同参与专项化、实践性的人才培养。要善用学科外的知识和方法,善用法律诊所、国际模拟法庭/仲裁庭竞赛和实习基地以开展实践培养。In the new era of Chinas active participation in the reform and construction of the global governance system,the state has put forward new tasks and requirements for the training of foreign⁃related legal talents.The problems existing in Chinas traditional training mechanism that affect curriculum construction need to be reformed urgently,including the mismatch with the national strategic demand,the unbalanced distribution of foreign⁃related legal talents and platform areas,the insufficient supply of supporting educational resources and services,and the lack of training effectiveness evaluation mechanism.In the future,we should develop the paradigm of legal doctrine and construct a set of endogenous norm system with international law as its noumenon.Including advocating a teaching system that takes“normative acquisition”as the logical starting point,the application of laws as the core content and rights relief as the fundamental basis.We should pay attention to the interdisciplinary integration under the concept of“new liberal arts”,and at the same time,we should pay attention to the deep integration of law and foreign language teaching,so as to construct the“trinity”talent training mechanism of“major plus foreign language”.We suggest that Chinas Ministry of Justice timely launch the non⁃mandatory foreign⁃related exam for legal professionals in parallel with the existing exam for legal professionals.Finally,the human resources of foreign⁃related practical departments should be deeply introduced,so that they can participate in specialized and practical personnel training.We should be good at invoking knowledge and methods outside disciplines,and make good use of legal clinics,international mock trial/Arbitration Tribunal competitions and practice bases to carry out practical training.
