认罪认罚案件判决中“一般应当采纳”的适用

摘　　要：“一般应当采纳”的范围应当包括罪名、量刑建议和程序适用,并不仅限于罪名和量刑建议。人民法院独立认定案件事实、证据并适用法律,在得出评价结论后会在合理范围内兼顾人民检察院指控内容,法检是主次关系,并非对立冲突。对罪名和量刑建议的采纳是在事实情节认定一致基础上的采纳,如果法检对事实情节认定不一致则无采纳基础,也就不涉及采纳例外和量刑建议明显不当的调处程序。在程序的采纳方面,应将程序适用纳入采纳范围。“一般应当采纳”模式下应实行严格审查,明知性和明智性应与自愿性并列,对具结书真实性与合法性的审查是涉及实体和程序的实质审查,应当区分程序瑕疵、一般违法和严重违法的情形并确立相应的程序性制裁措施。The scope of“shall generally be adopted”includes the charge,sentencing suggestion,and application of procedure,not only the charge and sentencing suggestion.The process and result of the court’s determination of case facts,evidence and law is an independent judgment without interference.After reaching the evaluation conclusion,the court will take into account the contents charged by the procuratorate within a reasonable range.The relationship between the court and the procuratorate is primary and secondary,rather than conflicting and opposite.The adoption of charge and sentencing suggestion is on the basis of consistent identification of facts and circumstances,if the court and the procuratorate do not have a basis for the identification of facts and circumstances,it does not involve the adoption of exceptions and mediation procedure for the obviously improper sentencing suggestion.In the adoption of the procedure,the application of the procedure should be included in the scope of adoption.Under the mode of“shall generally be adopted”,a strict examination should be carried out,and knowingness and intelligence should be guaranteed together with voluntariness.The examination of authenticity and legality of the affidavit is the substantive examination involving entities and procedures.We should distinguish procedural defects,general violations and serious violations,and establish the corresponding procedural sanctions.
