司法民主视域下人民陪审员制度的实践检视和路径展望——以人民陪审员全过程实质参审为切入

摘　　要：人民陪审员制度根植于中国特色社会主义法治实践的沃土,融汇了世界司法文明和民主价值理念,在人民司法制度体系中闪耀着夺目的司法民主光辉。近年来,我国人民陪审员制度在立法和实践层面取得诸多新成果和新发展。但从人民陪审员参审过程和程度等方面实证数据分析,人民陪审员制度在司法实践中发挥的功能仍然有待强化,应从强化理念、严控范围、保障权利和完善配套四个方面进一步探索,完善人民陪审员全过程实质参审的现实路径。The people's juror system is rooted in the fertile soil of the socialist rule of law practice with Chinese characteristics,integrates the world's judicial civilization and democratic values,and shines with dazzling judicial democracy in the people's judicial system.In recent years,the people's juror system in China has made many new achievements and developments in legislation and practice.However,the empirical data analyses of the process and extent of the people's jurors’participation in the trial reveal that,the function of the people's juror system in judicial practice still needs to be strengthened.It should be further improved from such four aspects as strengthening the idea,strictly controlling the scope,protecting rights,and improving the supporting facilities so as to improve the practical path of the people's jurors'substantive participation in the whole process.
