摘 要:艺术家在创作过程中产生的艺术信息可以用商业秘密法规范予以保护。艺术信息不仅包括工作底稿、设计初稿、绘图草稿等阶段性成果,也包括艺术团体的客户名单。但是,相关艺术信息必须符合“非公知性”“价值性”和“保密性”的要求,方可构成法律意义上的商业秘密。艺术家个人的知识技能和工作经验及其形成的“艺术体验”,不属于商业秘密的保护范畴,在合理人才流动过程中也不应当被限制适用。单纯的思想观念和构思理念,如果没有现实化和文字化,也不是商业秘密法规的保护对象。The artistic information produced by artists in the process of creation can be protected by trade secret law. Art information includes not only the working paper, design draft, drawing draft and other stage results, but also the client list of the art group. However, relevant art information must meet the requirements of "non-public", "value" and "confidentiality" before it can constitute a trade secret in the legal sense. Artists’ personal knowledge, skills and work experience as well as their "artistic experience" do not belong to the scope of trade secret protection, nor should they be restricted in the process of rational talent flow. Simple ideas and concepts are not protected by trade secret laws and regulations if they are not realistic and written.
