社会组织提起环境行政公益诉讼的证成与型构

摘　　要：针对社会组织能否提起环境行政公益诉讼,现有文献多从价值论与解释论角度展开学理论争,目前已形成“肯定说”与“否定说”两种对立的观点。社会组织提起环境行政公益诉讼在监督环境行政机关依法履行监管职责与防范检察机关滥用环境行政公益诉权方面应有的二元价值既诠释了此类诉讼的正当性,也彰显了此类诉讼的适用场域。因此,建议分别从诉权配置的模式选择与起诉资格的要件设置两个维度对社会组织提起环境行政公益诉讼的诉权进行立法配置,从诉权顺位的设计与公告程序的构造两个层面探寻此类诉讼的实现路径,进而推动环境行政公益诉讼的类型扩增与制度健全。For whether social organizations can file environmental administrative public interest litigation, the existing literature mostly launches the viewpoint debate from the perspective of axiology and hermeneutics. There are two opposite viewpoints of positive theory and negative theory. The dual value of environmental administrative public interest litigation filed by social organizations in supervising the environmental administration to perform its regulatory duties according to law and preventing the procuratorate from abusing the environmental administrative public interest litigation right, not only explains the legitimacy of such litigation, but also highlights its applicable field. In order to promote the type expansion and system improvement of environmental administrative public interest litigation, it is suggested to allocate the litigation right of environmental administrative public interest litigation by social organizations from two aspects, which include the mode selection of litigation right allocation and the elements of litigation qualification, and meanwhile, explore the realization path of such litigation from two aspects, which include the design of litigation right sequence and the construction of announcement procedure.
