我国家事调查员制度的困境与出路

摘　　要：家事调查员制度的建立是我国家事审判改革的内在要求,对于妥善解决家事纠纷具有重要意义。目前我国的家事调查员制度尚处于初步探索阶段,由于缺乏法律规范的引导,该制度在实际运行中存在家事调查员身份定位不明、来源分散,职责划分不明、角色混同,家事调查报告性质认定不明、规范缺位等问题。对此,有必要统一家事调查员的选任机制、规范家事调查员的工作职责、完善家事调查报告的利用,以充分发挥家事调查员制度的优势。The establishment of the Family Investigator System is the internal requirement of the reform of family trial,which is of great significance to solving the family disputes properly.At present,the Family Investigator System in China is still in the preliminary exploration stage.Due to the lack of guidance on legal norms,there are some problems in the actual operation,including unclear identity positioning,source dispersion,unclear division of responsibilities,role mix,ambiguous nature of family investigation reports,and absence of norms.In this regard,it is necessary to unify the selection mechanism of family investigators,standardize the work duties of family investigators,and improve the relevant contents of the family investigation report,so as to give full play to the advantages of the Family Investigator System.
