“个案公正”视角下法学教育改革路径研究

摘  要:“努力让人民群众在每一个司法案件中都感受到公平正义”,是习近平总书记对政法机关提出的明确要求,也是推进全面依法治国、建设中国特色社会主义法治体系、建设社会主义法治国家的重要目标。司法是维护社会公平正义的最后一道防线,实现个案公正关乎每一个当事人的切身利益,亦是法治社会的必然要求。法治社会的建设和运行需要法治人才的储备,实现个案公正与司法机关办案水平和能力密切相关,法学教育承担着培养德才兼备的高素质法治人才的任务,在推动实现个案公正中居于不可替代的作用。法学教育应当注重理论与实践相结合,关注个案公正,围绕案例教学进行教育改革。案例教学法关注对个案的分析、类案的检索、检索报告撰写和使用、类案裁判一致性等问题的研究和教学,通过高水平的法学教育推动司法工作高质量发展,促进个案公正目标的实现。“To make every effort to guarantee the people feel fairness and justice in every judicial case”is a clear requirement put forward by General Secretary Xi Jinping to the organs of political and law,and it is also a major goal of promoting Chinas overall law⁃based governance,building a socialist legal system with Chinese characteristics and building a socialist country ruled by law.Judiciary is the last line of defense to safeguard social fairness and justice.The realization of case justice concerns the vital interests of each party,and it is also the necessary requirement of law⁃based society.The construction and operation of law⁃based society requires the reserve of legal talents.The realization of case justice is closely related to the level and ability of judicial organs in handling cases.Legal education undertakes the task of cultivating high⁃quality legal talents with both political integrity and ability,and plays an irreplaceable role in promoting the realization of case justice.The legal education should pay attention to the combination of theory and practice,concern about the case justice,and carry out the educational reform around the case teaching.The case teaching method focuses on the research and teaching of case analysis,case retrieval,writing and use of retrieval reports,consistency of similar case judgments.It promotes the high⁃quality development of judicial work and the realization of the goal of case justice through high⁃level legal education.
