研究生国家奖学金评定规则的法治化建构——基于41所高校规范文本的考察

摘  要:研究生国家奖学金评定规则尚缺乏法治化的理论建构。研究生国家奖学金的设置意旨在于激励个体以及完善教育体系,应当通过行政法基本原则保障此两项意旨的实现。在法治模式上,现行的规范主义控权模式,已经不适应现实需要。应建构功能主义的建构模式,通过原则之治保证研究生国家奖学金评定规则的形式正义、实质正义与程序正义;通过行政法定原则、行政均衡原则、行政正当原则规制研究生国家奖学金评定中的评定依据、评定内容、评定程序以及救济机制。The evaluation rules of the postgraduate national scholarship lack the theoretical construction of the rule of law.The empirical research shows that the rules for the evaluation of postgraduate national scholarship formulated by universities have problems,such as the basis of evaluation deviates formal justice,the lack of procedural justice in the evaluation procedure,the content of the evaluation is implemented lacking of substantive justice,and the remedy mechanism is not perfect.The purpose of the graduate national scholarship is to encourage individuals and improve the educational system,and the basic principles of administrative law should be adopted to ensure the realization of these two purposes.In terms of the mode of the rule of law within the system,the existing normative control mode is no longer suitable for practice.It is necessary to construct a functionalist mode to ensure the formal justice,substantive justice,and procedural justice of the evaluation rules of postgraduate national scholarship through the statutory principle,the principle of administrative balances and the principle of due process to regulate the basis,content,procedure and remedy of the evaluation.
