摘　　要：中国知识产权全球治理体系改革面临着美国涉华“337调查”频率增加、数据跨境流动风险上升以及技术出口管制收紧等单边主义政策的挑战。知识产权全球治理的国际局势产生了大量涉外法治人才需求。在涉华“337调查”纠纷中,涉外法治人才应当具备强化企业知识产权海外管理、掌握出口贸易规则、处理政府公共关系以及应用知识产权国际贸易规则的能力;在数据跨境流动中,涉外法治人才应当熟悉国际谈判模式与规则制定流程,有效破解知识产权管辖冲突,多渠道推动数据跨境流动合规;在技术出口管制应对过程中,识别管控成分并加强业务规范、开展风险筛查、善用博弈措施和反制手段是涉外法治人才应当具备的素养。要坚持问题导向培养高质量涉外法治人才,为我国全面参与知识产权全球治理提供智力资源,推动知识产权全球治理体系变革。The reform of China’s Intellectual Property global governance system is challenged by unilateralist policies such as the increased frequency of US “337 investigation” involving China, the increased risk of crossborder data flows and the tighter technology export controls. The international situation of global Intellectual Property governance has created a high demand for foreign-related legal professionals. Foreign rule of law talent should be able to strengthen enterprises’ IPR overseas management, master export trade rules, handle government public relations, and apply IPR international trade rules in China-related “337 investigation” disputes. Foreign rule of law talent involved in cross-border data flow should be familiar with international negotiation models and rule-making processes, be able to effectively resolve Intellectual Property jurisdictional conflicts, and promote compliance with cross-border data flow through multiple channels. In the process of responding to technology export controls, foreign rule of law talent should be capable of identifying control components and strengthening operational regulations, conducting risk screening, and making effective use of gaming measures and countermeasures during the technology export control response process. We should adhere to problemoriented training of high-quality foreign-related rule of law talent, provide intellectual resources for China’s full participation in global Intellectual Property governance, and promote the change of the global Intellectual Property governance system.
