摘　　要：当前贪污贿赂犯罪认罪认罚存在适用比例低、律师辩护作用小、上诉率高而改判率低等问题,其原因主要在于“两法”对认罪认罚规定不统一、检察机关主导作用受限、自愿性保障不足、控辩协商缺失、法院审查形式化等。建议统一适用标准,实现监察机关与检察机关认罪认罚从宽的有效衔接;充分发挥检察机关的主导作用,加强对监察调查权的制约;保障认罪认罚的自愿性和合法性;完善刑事辩护制度,强化控辩协商;坚持以审判为中心,充分保障被告人的上诉权,以期破解贪污贿赂犯罪适用认罪认罚从宽制度的难题。At present, there are problems such as low application rate, little defense function of lawyers, high appeal rate and low revision rate for pleading guilty to corruption and bribery crimes. The main reasons for this are the lack of uniformity in the provisions of the two laws on pleading guilty, the restricted leading role of the procuratorial organs, the insufficient guarantee of voluntariness and legality, the lack of negotiation between prosecution and defense, and the formalization of court review. It is recommended to unify the applicable standards to achieve an effective connection of leniency of pleading guilty between the supervisory organs and the procuratorial organs;give full play to the leading role of the procuratorial organs and strengthen the restriction of supervision and investigation power;guarantee the voluntariness and legitimacy of pleading guilty;improve the criminal defense system, strengthen the negotiation between prosecution and defense;adhere to the trial as the center, fully protect the defendant’s right to appeal, so as to solve the problem of the application of the leniency system for corruption and bribery crimes.
