摘 要:随着行政公益诉讼案件范围拓展,这项制度开始直面公民权利保护问题,有了功能补缺的机会。行政公益诉讼实施权利保护的理论逻辑在于,通过督促服务行政和监督秩序行政促使权利保护被吸收到法律实施制度逻辑中,从而上升为秩序目标。但在司法实践中,由于检察机关以利益代表制为逻辑起点行使诉权,从而未能深入监督秩序行政,对服务行政义务也没有进行规范层面的明确和类型化区分。对此,行政公益诉讼实施权利保护应当调整进路,以法律监督为理据,致力于填充秩序漏洞和构建平等分享之秩序。为了保障行政公益诉讼实施权利保护,还需要强化诉讼的客观属性,扩展被告资格范围,以及构建适配性的激励机制。With the expansion of the scope of administrative public interest litigation,the system has begun to face the issue of civil rights protection and has the opportunity to fill the gap.The theoretical logic of administrative public interest litigation is to promote the protection of rights through the supervision of service administration and orderly administration,and thus to promote the protection of rights into the logic of the law enforcement system,thus rising to the goal of order.However,in judicial practice,because the procuratorial organs take the interest representation system as the logical starting point to exercise the right to sue,thus failing to supervise the orderly administration,and the service administration obligation is not clearly defined and differentiated at the normative level.In this regard,the administrative public interest litigation should be adjusted to protect the rights of legal supervision,and to fill the loopholes of order and build the order of equal sharing.In order to ensure the protection of rights in administrative public interest litigation,it is necessary to strengthen the objective nature of litigation,expand the scope of the defendant’s qualification,and build a suitable incentive mechanism.
