摘 要:医院劳动关系的和谐稳定涉及我国基本的民生问题。医生作为专业技术人员,因与医院确定了较长的服务期,故在其辞职时面临被医院要求退回培训期间的劳动报酬,并且需要支付较高的违约金,需承担医院的经济损失等。医生辞职所面临的问题源于在司法实践中将医生与医院的争议定性为人事争议。实际上在我国医疗卫生事业改革之后,医生和医院的关系与劳动关系趋于一致,应当按照《劳动合同法》的规定来规范医生的辞职权,使其适应市场经济条件下医疗卫生事业的健康发展。The harmony and stability of hospital labor relations is a basic livelihood issue in China.As a medical specialist,doctors often have signed long-term employment contracts with hospitals.At the time of resignation,hospitals will require the doctors to return the labor remuneration during the training period,pay high liquidated damages,and bear the economic losses of the hospitals.In judicial practice,the problems faced by doctors during resignation are often characterized as personnel disputes.In fact,after the reform of China’s medical and health services,the relationship between doctors and hospitals tends to be labor relations.The resignation right of doctors should be regulated in accordance with the Labor Contract Law,so as to ensure the healthy development of medical and health undertakings under the conditions of market economy.
