论依法公开个人信息的“合理”处理

摘　　要：依法公开个人信息存在从间接保护到直接保护的模式变迁。转介传统名誉权、隐私权的间接保护模式,已无法满足现实治理需求。然而,由于“合理”处理要件存在适用上的模糊,以《个人信息保护法》第27条为核心的直接保护模式,尚难以有效回应实践争议。问题的实质在于消解信息流通与风险控制间的紧张关系,重塑依法公开个人信息保护的法律秩序。“合理”的认定,应以场景理论与融贯解释为核心,借由《民法典》第998条,运用动态体系的解释技术展开。在场景化讨论与比较命题的支撑下,对于依法公开个人信息的爬取与标签提取,应属合理处理;人物画像与自动化决策,原则上非属合理范围;关联分析等行为,则应当综合考量信息主体、信息识别性及敏感性等要素,在个案中得出具有开放性和包容性的结论。The model of the protection for personal information disclosed according to law has changed from indirect protection to direct protection.The indirect protection model for traditional reputation rights and privacy rights could hardly meet the practical needs of governance.However,due to the ambiguity in the application of the“reasonable”handling requirements,the direct protection model centered on Article 27 of the Personal Information Protection Law still cannot effectively respond to practical disputes.The essence of the problem is to resolve the tension between information circulation and risk control and reshape the legal order for the protection of personal information disclosed according to the law.The determination of“rationality”should be centered on scene concepts and holism interpretation and carried out by using the interpretation technique of the dynamic system under Article 998 of the Civil Code.With the support of scenario-based discussions and comparative propositions,the crawling and tag extraction of personal information disclosed according to law should be considered as reasonable handling;character portraits and automated decision-making should not be covered in the scope of reasonable handling in principle;For behaviors such as correlation analysis,factors like information subject,identification and sensitivity should be comprehensively considered to get open and inclusive conclusions in individual cases.
