晚清内地华洋诉讼中的“华强洋弱”现象——以巴县档案为对象的考察

摘　　要：学界对晚清华洋诉讼的关注基本都是以上海等租界地区的会审公廨为研究对象,在租界模式下,华洋官员的地位表现出极不平等性,呈现为洋官的“把持袒护”与地方官的“听客所为”。本文以巴县华洋诉讼档案为研究对象,通过具体案例分析,展现了内地地方衙门理案模式下的“华强洋弱”现象。The previous researches on sino-foreign lawsuits in the Late Qing dynasty mainly focused on the Mixed Court in Shanghai which was in the Foreign concession.On the Mixed Court,the status of Chinese and that of foreign officials were extremely unequal.The foreign officials always played a dominant role while the local officials were obedient.Based on the Baxian archives,this paper demonstrates the phenomenon of“China stronger than West”under the traditional magistrate’s trial mode.
