摘 要:《化妆品监督管理条例》于2021年1月1日实施以来,对进口化妆品违法行为尤其是对境外化妆品注册人、备案人的违法行为开展调查取证、实施行政处罚的规定不明确,造成执法人员执法困难,行政处罚有失公正,为维护公共利益和社会秩序,保护公民、法人或者其他组织的合法权益,亟需规范建立相关工作机制.笔者通过学习研究相关立法规定,对如何依法处理进口化妆品违法行为形成一定共识.Since the Regulations on Supervision and Administration of Cosmetics came into effect on January 1,2021,unclear provisions on investigation,evidence collection and implement administrative punishment of the illegal acts of imported cosmetics,especially on the illegal behavior of the overseas registrant and the filing cntity of cosmetics,have caused difficulties in law enforcement and unfairness in administrative punishment.It's urgent to standardize and establish relevant work mechanisms to safeguard public interests and social order,to protect the legitimate rights and interests of citizens,legal persons and other organizations.The authors have reached a consensus on how to deal with illegal behaviors of imported cosmetics according to law by studying,researching and discussing relevant legislative provisions.
