晚清民国雅水布依族村寨土地绝卖契约考察

摘　　要：土地契约文书是反映封建社会土地私有制下一定时期内的经济行为。土地绝卖契约是相对于典当契约、活卖契约的一种契约交易活动。契约中永远管业字样,是绝卖契约、断卖契约的显著标志。契约体现买卖自由原则、归户性、买卖内容多样、买主构成主体以及单契为主等不同特征。分析影响契约买卖因素,有利于了解雅水地区经济文化的发展、少数民族民俗。对窥见当地社会变迁具有重要意义,是当时农民生产生活、市场经济发展状况的真实反映。A contract for land leases reflects the economic behavior in a certain period under private ownership of land in feudal society.The land sale contract is a kind of contract transaction activity,which is relative to pawn contract and a live of the sale contract.In the contract,the word"forever managing the industry"is a significant symbol of the sale off contract and the sale off contract.The contract embodies the different characteristics of the principle of freedom of purchase and sale,home ownership,diversified content of purchase and sale,buyer as the main body and single contract as the main body.The analysis of the factors affecting the contract sale is conducive to understanding the economic and cultural development and ethnic customs in Yashui.It is of great significance to glimpse the local social changes,and is a true reflection of the production and life of farmers and the development of market economy at that time.
