摘 要:《中华人民共和国行政复议法(修订草案)》将涉及行政协议的不依法订立、不依法履行、未按照约定履行和违法变更、解除五种情形纳入行政复议范围,从与行政诉讼衔接关系上看,行政复议还应当增加行政协议生效与否等五种情形。基于行政协议复议审查的要求,应当确立合法性、合约性两个审查基准;根据行政协议的“行政性”和“协议性”特点,申请人也应当承担相关的举证责任;从行政协议争议的结构上看,行政协议复议审查应当遵循行政协议关系审查和行政协议行为审查的“双阶审查”方式。除了针对行政协议专门规定的承担继续履行责任复议决定方式外,还应当增加确认决定等行政协议复议决定方式。The Administrative Reconsideration Law of the People’s Republic of China(Revised Draft) involved the five cases in the scope of administrative reconsideration, including illegal conclusion of administrative agreement, failure to perform the obligation in accordance with the law, failure to perform in accordance with the agreement, illegal change the contract and illegal dissolution the contract From the perspective of the derivative relationship with administrative litigation, five situations should be added, such as whether the administrative agreement is effective or not.
