摘 要:在环境民事公益诉讼司法实践中,检察机关与侵权人在诉前达成和解的现象较为普遍,这对节约诉讼资源、促进纠纷多元化解决、及时保护公共利益发挥了很大作用,但也面临理论依据不足、启动程序缺失及和解协议缺乏监督等问题,制约了环境民事公益诉讼的发展。构筑我国环境民事公益诉讼诉前和解机制,不仅要完善案件审查、听证程序及司法确认程序,也要明确其适用范围、启动方式及鉴定方法,从而提高环境侵权纠纷解决的整体效率,进一步健全我国环境民事公益诉讼制度。In the judicial practice of environmental civil public interest litigation, it is common for procuratorial organs and infringers to reach a settlement before litigation, which has played a great role in saving litigation resources, promoting the diversified settlement of disputes, and protecting public interests in a timely manner. However, there are also problems such as insufficient theoretical basis, lack of starting procedures, and lack of supervision over the settlement agreement, which restrict the development of environmental civil public interest litigation. To build the pre-litigation reconciliation mechanism of environmental civil public interest litigation in China, we should not only improve the case review, hearing and judicial confirmation procedures, but also clarify their scope of application, launching methods and appraisal methods, so as to improve the overall efficiency of environmental tort dispute resolution and further improve the environmental civil public interest litigation system in China.
