摘 要:区块链技术具备分布式、透明性、可追溯、防篡改等特征,可提高数据的可信度和安全性,推动国家治理体系和治理能力现代化。国内外学者借助区块链技术优化取证、存成模型的尝试已初见成效,使得电子数据取证已成为现实。但随之而来的技术依赖、证据鉴真风险和权利侵犯风险等问题也逐渐凸显。文章在区块链技术的视阈下,审视目前电子数据取证中区块链技术的理论研究和实践应用,从技术、权利和数据真实性三个层面提出问题,并尝试从“代码”与法律的融合、搭建公检法司联盟链平台、关键技术开发等三个方面寻求解决方法,以期为区块链技术在电子数据取证中的应用提供有益参考。Blockchain is characterized by distribution,transparency,traceability and tamper-proof,which can enhance the credibility and security of data and facilitate the modernization of national governance system and governance capacity.The attempts of domestic and international scholars to optimize forensics and storage models with the help of blockchain have begun to bear fruit,making electronic data forensics a reality.However,the issues of technology dependence,risk of evidence fidelity and risk of rights infringement have also come to the fore.In view of this,the article examines the theoretical research and practical application of blockchain in electronic data forensics,raises problems from three levels of technology,rights and data authenticity,and tries to seek solutions from three aspects:the integration of“code”and law,the establishment of the alliance of police procuratorate,courts and justice division,and key technology development,aiming to offer insights into the application of blockchain in electronic data forensics.
